if you need to know how to test it :
- equip this trinket : http://www.wowhead.com/item=96558/unerring-vision-of-lei-shen ( what ilvl you want )
- go at test dummy
- make the trinket proc
-reapply DoTs with the trinket up
- see the recounter on the number of crits / normal hits

*Also it has been told to me that on Test Realm the snapshot on crit was working, maybe this would help??

It isn't just this trinket bug, it's crit generally because it updates dynamically for ex when u apply a dot you have 30% crit and then u gain 100% crit for 1 min for the entire minute u will crit.

Fixed DoT crit snapshot for warlocks and shadow priests. If other classes/specs should snapshot DoT crit we need more info/proof

For shadow priests I also implemented the blizzlike failsafe:
