Reason to penalize?

I won an item in a raid for my dual spec, I noticed the only person in the party who could use the item and as I had already decided to participate roll. After a while I realize that had bugeada the interface of the party and there was another person who could use the item. What happens to that person was less than ilvl requested to enter the party, pedia 520 and this person was 499 (I think it was the guild's leader).
Then I told him that he would not give the item because I was in that raid "legally" and that was not for carry people who did not respect the ilvl of the party. What I received this answer:

You can only choose either to ignore people like this, or not participating in this kind of raids since they are "ninjas". Mute requests are only for global chat. According to the current rules, no penalty available for this kind of problems.
