Legendary back PVP bug

Hello,I queued for a battleground and I played against an enemy rogue that was using the legendary back.For some reason,it was proccing on me when it shouldn't.
The legendary back shouldn't proc in INSTANCED pvp combat.The battleground is an instanced pvp zone so it shouldn't.
This is confirmed by blizzard ,community and by wow gamepedia.

By wow gamepedia: as mentioned in the patches and hotfixes tab Hotfix (2013-09-13): "Effects for Legendary cloaks no longer activate while fighting against other players." confirms it shouldn't be working against players and if it does,it is a bug.

By community: I have chosen arenajunkies since it was very popular back in mop.There was a thread where people were talking about the legendary cloak and the PvE items being used in pvp which included that the back is not proccing in instanced pvp.

Well it doesnt proc only in arenas and rated bgs ... in random bgs and world pvp its normal to proc ... but everyone speak about this things all around ... but when some one report a lot of times in the past 2-3 months that trinkets , synapsis springs and nitro boots must not break stealth ... but still do no one gives a fu ... about this things but when is about a cloack proc in a place where is normal to proc every one screams and report and .... yeah ... welcome to WoW-Freakz Have a nice journey
